Start with whether the experience is real

The rule addresses reviews that misrepresent an actual experience, including purported customers who never used the product. Do not convert an AI-written scenario into a customer quote or publish a freelancer’s invented experience. Keep consent and provenance for testimonials. A plausible sentence and a stock avatar do not establish that a real user completed the task described.

Check what the incentive depends on

The FTC distinguishes incentives conditioned on positive or negative sentiment from incentives without that condition. Its guidance also notes disclosure obligations and other potential deception concerns. Platform rules can be stricter than this legal distinction. Do not assume that disclosing a payment makes a paid App Store review acceptable; evaluate the store contract separately from the US legal rule.

Review the entire marketing workflow

Audit agency briefs, testimonial forms, referral rewards and the person approving the material. Give staff a way to reject questionable claims before they become ads or landing-page quotes. Record which user supplied each statement and what editing occurred. If a quote is only an illustrative example, label it visibly. Preserve criticism rather than presenting selectively obtained feedback as the opinion of every customer.

An internal testimonial record can contain the user’s permission, the original statement, the app version used, any compensation or relationship, edits proposed and approval to publish the edited wording. An invented ‘average user’ statement belongs in an example box, not a testimonial carousel. Ask counsel to review uncertain cases before the campaign runs.
